MTNTOUGH Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the MTNTOUGH mobile application, the LOGBK mobile application, the website at lab.mtntough.com, and any related services, content, and features (collectively, the “Services”) provided by MTNTOUGH Inc. (“MTNTOUGH,” “we,” “us,” or “our”).

By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. The Services

MTNTOUGH provides functional fitness programs, workouts, coaching content, and related tools designed for mountain athletes, backcountry hunters, military personnel, and others seeking physical and mental toughness training.

LOGBK is a workout logging and strength tracking application. It allows users to log workouts, track sets, reps, loads, and progress. Certain features in LOGBK, including access to MTNTOUGH+ programs and daily workouts, require an active MTNTOUGH+ membership.

The Services provide fitness guidance and tracking tools only. They are not medical advice. Consult a physician before beginning any training program.

2. Accounts

To access certain features, you may need to create an account using an email address. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You agree to provide accurate information and to keep it updated.

3. MTNTOUGH+ Membership and Subscriptions

MTNTOUGH+ is a paid membership that unlocks premium programs, daily workouts, and related content across the MTNTOUGH and LOGBK applications.

  • Website purchases: Memberships purchased on lab.mtntough.com are processed by our website payment provider and are subject to the pricing, renewal, and cancellation terms presented at checkout and on our website.

  • In-app purchases: Memberships purchased inside the MTNTOUGH or LOGBK apps via Apple In-App Purchase are processed by Apple and are subject to Apple’s terms and payment policies. A purchase made inside LOGBK creates or renews a MTNTOUGH+ membership that works in both the MTNTOUGH and LOGBK applications. You can manage or cancel an Apple-purchased subscription in your Apple Account settings.

  • Auto-renewing subscriptions continue until canceled. You must cancel at least 24 hours before the end of the current billing period to avoid the next charge. Refunds are handled according to the policies of the platform through which the purchase was made (Apple or our website).

We may change subscription pricing with notice as required by applicable law and platform rules. Continued use after a price change constitutes acceptance of the new price where permitted.

4. Free Features and LOGBK

LOGBK may be used without a membership for manual workout logging and related tracking features. Access to MTNTOUGH+ programs and certain other content requires an active membership.

5. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose

  • Attempt to reverse engineer, copy, or redistribute the content or software

  • Interfere with the operation of the Services

  • Share account access in a way that violates these Terms or platform rules

  • Upload or transmit harmful content

6. Intellectual Property

All content, programs, workouts, text, graphics, logos, and software in the Services are owned by MTNTOUGH or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes in accordance with these Terms. You may not copy, distribute, or create derivative works without our written permission.

7. User Content

Any workout data, notes, or other content you create in the Services remains yours. You grant us a limited license to store, process, and display that content solely to provide and improve the Services. We do not claim ownership of your workout logs.

8. Apple-Specific Terms

If you access the Services through an Apple device:

  • These Terms are between you and MTNTOUGH, not Apple.

  • Apple has no obligation to provide support or maintenance for the Services.

  • Apple is not responsible for any claims related to the Services, including product liability, intellectual property, or consumer protection claims.

  • You must comply with Apple’s applicable terms.

9. Disclaimer of Warranties

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, MTNTOUGH and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim arising from these Terms or the Services shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless MTNTOUGH from any claims, damages, or expenses arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason. You may stop using the Services at any time. Upon termination, your right to use the Services ends, but sections that by their nature should survive will continue to apply.

13. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of Montana, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Montana.

By using the Services, you acknowledge that you have read, understood, and agree to these Terms of Service.
